The Issues - Mill Levy Freeze = Property Tax Increase

On May 30, 2008, a Colorado court ruled that the controversial mill levy freeze that resulted in a property tax increase is indeed unconstitutional.

In March of 2007 the democrat controlled house, senate and governorship  passed a bill that prohibited school districts and counties from raising OR lowering the mill levy.

In Mesa County, that meant for almost all property owners – especially BUSINESS property owners, an INCREASE in the property taxes.

According to the Taxpayer Bill of Rights – TABOR- which was adopted to the Colorado Constitution in 1993, any tax increase, or any new tax, OR any legislation that results in a tax increase or new tax MUST be voted on by the citizens.

Herein lays the issue. The mill levy freeze was ruled unconstitutional because it resulted in a tax increase. The end? NO

The governor plans to spend our taxpayer time and money to appeal this court decision.  We do not know what will happen or when.

If the house and senate were not controlled by a majority of democrats, this legislation would have been harder to get passed.

Laura believes that the legislators are obligated by oath to uphold the constitution of this state.

Laura believes in the TABOR amendment’s goal of restraining the growth of government.

Laura, when elected, would vote to keep TABOR intact; not vote to dismantle or circumvent it.

Both Governor Ritter and Rep. Bernie Buescher have been quoted, saying ‘it is the right thing to do’ – to raise taxes on the states’ citizens without asking for their vote on it…..like our constitution guarantees.

It cost us nearly $4 billion more in taxes.

Not a tax increase???

Laura has proudly signed the “No New Taxes Pledge”. She will vote to protect our dollars.
